Purpose
Joint Powers Agreement for the Conduct of Community Programs on Aging in Bernalillo County

2. Area Agency on Aging
The City of Albuquerque, Department of Family and Community Services shall serve as the Area Agency on Aging and be responsible for carrying out the planning, administration, monitoring, advocacy, coordination, interagency linkages, and information sharing functions designed to provide a comprehensive and coordinated community-based system of programs and services for older persons in Bernalillo County. Such responsibilities shall be performed in conjunction with an Advisory Council to the Area Agency on Aging.
3. Advisory Council
A. Establishment and functions
There is hereby established an eleven (11) member Area Agency Advisory Council, hereinafter referred to as the “Albuquerque/Bernalillo County Older Americans Advisory Council”. The council shall advise the Area Agency on Aging relative to the following:
1) Developing and administering the “Area Plan”;
2) Conducting public hearings;
3) Representing the interests of older persons;
4) Reviewing and commenting in all community policies, programs and actions which affect older persons with the intent of assuring maximum coordination and responsiveness to older persons; and
5) Reviewing and commenting on Area Plans and amendments submitted to the State Agency on Aging for approval to conduct programs and services within the County.
B. Composition
The membership of the Albuquerque/Bernalillo County Older Americans Advisory Council shall meet the requirements of the Older Americans Act by including individuals and representatives of community organizations who will help to enhance the leadership role of the Area Agency on Aging in developing community-based systems of services. Members selected may not serve on advisory or policy bodies of agencies receiving Older Americans Act funds while serving as a member of the Albuquerque/Bernalillo County Older Americans Advisory Council.
The Council shall be made up of:
1) More than 50% older persons (aged 60 and over), including minority individuals who are participants or who are eligible to participate in programs offered under the Older Americans Act;
2) Representative of older persons;
3) Representatives of health care provider organizations not funded through the “Area Plan”;
4) Persons with leadership experience in the private and voluntary sectors;
5) Local elected officials; and
6) The general public
C. Selection of Members
The Albuquerque/Bernalillo County Older Americans Advisory Council shall consist of eleven (11) residents of Bernalillo County with initial representative appointments made at the time of approval of this Agreement.
Members shall be appointed as follows:
1) The City of Albuquerque shall appoint six (6) members with one member representative of healthcare provider organizations not funded through the “Area Plan”, one member representative of supportive service provider organizations not funded through the “Area Plan”, one member representative of the general public or local elected officials (who may or may not be older individuals aged 60 and over), and three members representative of older persons including minority individuals who are participants or who are eligible to participate in programs funded through the Older Americans Act (aged 60 and over).
2) The County of Bernalillo shall appoint three (3) members with one member representative of private and voluntary sectors within the County, one member representative of either the general public or local elected officials (who may or may not be older individuals aged 60 and over), and one member representative of older persons including minority individuals who are participants or who are eligible to participate in programs funded through the Older Americans Act (aged 60 and over).
3) The Village of Los Ranchos de Albuquerque shall appoint one member representative of older persons including a minority individual who is a participant or who is eligible to participate in programs funded through the Older Americans Act (aged 60 and over).
4) The Village of Tijeras shall appoint one member representative of older persons including a minority individual who is a participant or who is eligible to participate in programs funded through the Older Americans Act (aged 60 and over).
The term of membership on the Council shall be for the period of time specified by the appointing parties. All vacancies shall be filled within sixty (60) days of receipt of voluntary resignation or termination and shall be filled in the same manner as the original appointments.
